Preamble & Basic Introduction

Xianggang Mengchuang is an integrated developer and global distributor of iOS mobile software, launching proprietary app products to all mainstream Apple App Store regions worldwide. All access rights to our iOS programs are provided subject to the binding rules recorded within this User Terms of Service.

All interactions between you and our platform shall be governed by the rules below. Xianggang Mengchuang reserves all rights not explicitly granted to end users in this document.

1. Authorized Usage Rules for iOS Software

1.1 Consent to Personal Data Processing

Once you launch or interact with our iOS applications, you provide unconditional consent to all data collection, storage and analytical processing actions defined in our independent Privacy Statement. Our privacy compliance framework fully satisfies the requirements of EU GDPR Regulation 2016/679 and cross-border data protection standards applicable to Apple ecosystem users.

1.2 Boundaries of Legal Use Scenarios

You commit to utilizing our iOS software solely for legitimate purposes compliant with two layers of constraints: the rules laid out in this Terms document, plus all local statutes, regulatory policies, industry standards and widely accepted internet operation norms in your resident jurisdiction. You shall strictly follow all local rules covering app download, installation on iOS devices, account login and daily functional use.

1.3 Separation of Third-Party Content Liability

Xianggang Mengchuang bears no legal accountability for external web pages, embedded third-party resources and cross-site content reachable via jump links inside our iOS Apps. You shall take full and sole responsibility for all operations executed under your account, and Xianggang Mengchuang shall not compensate you or any third party for losses arising from improper user conduct.

1.4 Automatic Version Upgrade Authorization

Our iOS software will regularly establish secure connections with Xianggang Mengchuang’s cloud server cluster to scan for available iterative updates, including bug repair patches, vulnerability fixes, expanded functional modules, missing auxiliary plugins and complete new release versions. By finishing the initial installation on your iPhone or iPad, you authorize the program to automatically request and receive these upgrade files without repeated individual confirmation.

1.5 Service Suspension & Termination Rights

Xianggang Mengchuang holds absolute discretionary power to temporarily restrict partial functions or permanently cease overall service supply for single users or all global users, without sending prior advance notices via pop-up, email or in-app message. If we block your access permission, you acknowledge that you will lose entry to the whole application or specified core modules temporarily or permanently.

You are prohibited from releasing, forwarding or publishing the following types of messages, files and media content through any chat, comment or message channel inside our iOS Apps:

2. Intellectual Property Ownership & Limited User License

2.1 Scope of Protected Intellectual Assets

All iOS application programs, native UI layouts, content compilation frameworks, page layout structures, original text, graphic materials, audio tracks, video footage, database data and embedded components within our software are exclusive proprietary assets of Xianggang Mengchuang, our authorized licensors and cooperative content suppliers. These resources receive full legal protection from global copyright, trademark and intellectual property laws. Reproduction, redistribution or secondary dissemination without Xianggang Mengchuang’s written approval is strictly forbidden.

2.2 Restrictions on User Usage License

Xianggang Mengchuang grants you a personal, revocable, non-exclusive and non-transferable limited license for individual non-commercial use only. Without our formal written authorization, you cannot perform reverse engineering, decompilation, disassembly, source code reconstruction or any modification to the full application or any independent component. You are not allowed to copy installation packages, resell access rights or carry out any commercial monetization activities relying on our iOS software. You shall not use frame embedding, hyperlink nesting or page embedding techniques to display our trademarks, logos, original texts and page layout designs for third-party commercial promotion. Any unauthorized violation will immediately invalidate your usage license, and we reserve the right to block your app access permanently.

3. Warranty Disclaimer and Liability Cap Regulations

3.1 "As Provided" Service Disclaimer

Xianggang Mengchuang does not provide any express or implied warranty regarding our iOS Apps, including but not limited to guarantees of uninterrupted operation, error-free function execution, full defect repair, and the accuracy or suitability of third-party ads and product recommendations displayed inside the software. All iOS applications are supplied on an "as-is, as-available" basis without additional quality guarantees. You confirm that all risks generated during your use of our software shall be fully borne by yourself.

3.2 Upper Limit of Compensatory Liability

Xianggang Mengchuang shall not be liable for any direct or indirect property loss, economic opportunity loss or reputational damage resulting from your use or inability to access our iOS services. For all compensation claims and legal disputes you raise against us, our total monetary compensation liability shall not exceed the actual payment amount you spent purchasing this iOS App via Apple App Store.

4. Applicable Law and Dispute Resolution Procedures

4.1 Governing Legal Jurisdiction

By accessing our iOS applications, you agree that the laws of Portugal shall exclusively govern the interpretation of this agreement and all disputes arising between you and Xianggang Mengchuang. This document excludes the application of conflict-of-law rules of any other region and explicitly rejects the United Nations Convention on Contracts for the International Sale of Goods. For consumer users, this law selection clause only applies within the scope that does not conflict with mandatory protective laws of your habitual residence country.

4.2 Dispute Settlement Process

Once a dispute occurs, both parties shall first conduct friendly negotiation to reach a mutually acceptable resolution. If consultation fails, all unresolved disputes shall be submitted to the Lisbon Court of Portugal for judicial judgment, unless mandatory local consumer laws entitle you to initiate litigation in the court of your residence area.

4.3 Time Limit for Filing Claims

All lawsuits, compensation claims and rights applications related to your use of our iOS Apps must be filed within twelve (12) months counting from the occurrence date of the disputed incident. Any claim submitted beyond this one-year statute of limitations shall lose legal validity and cannot be filed for judgment.

Xianggang Mengchuang reserves the right to revise, supplement or adjust all clauses of this User Terms irregularly to adapt to updated industry regulations, platform operation adjustments and cross-border legal policy changes.
